Buying and selling rules

GENERAL PROVISIONS, RIGHTS OF THE BUYER, OBLIGATIONS OF THE BUYER

1. General provisions

1.1. These rules for the purchase and sale of goods (hereinafter referred to as the Rules) upon their approval by the Buyer (after familiarizing themselves with the Rules and ticking the box next to the statement "I agree with the rules"), are a binding legal document for the parties, which determine the rights and obligations of the Buyer and the Service Provider, the purchase and payment of goods the conditions for them, the order of delivery and return of goods, the responsibility of the parties and other conditions related to the purchase and sale of goods in the electronic store at the online address www.21diena.lt (hereinafter - 21diena.lt).

1.2. MB "21diena", legal entity code 306623014, registration address Vilnius district. week, Maišiagala, Pievu st. 28 (hereinafter - the Service Provider).

1.3. 21diena.lt has the right to buy (hereinafter - the Buyer):

1.3.1. able-bodied natural persons, i.e. persons who have reached the age of majority, whose capacity is not limited by court order;

1.3.2. minors between the ages of 14 and 18, only with the consent of their parents or guardians, except in cases where they dispose of their income independently;

1.3.3. legal entities;

1.3.4. authorized representatives of all the above persons.

1.4. By approving the Rules, the buyer guarantees that he has the right to buy goods on 21diena.lt.

1.5 The contract between the Buyer and the Service Provider is considered concluded from the moment the Buyer forms an order on 21diena.lt and presses the "Order" button.

2. Buyer's rights

2.1. The buyer has the right to buy goods and order services on 21diena.lt in accordance with the procedure established by these Rules.

2.2. The buyer has the right to refuse the order in accordance with the procedure established by these Rules.

2.3. The buyer has the right to return the purchased goods in accordance with the procedure established by the Rules.

2.4. The buyer has other rights established in these Rules.

3. Obligations of the buyer

3.1. The buyer, using 21diena.lt, undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the laws of the Republic of Lithuania.

3.2. When purchasing on the website www.21diena.lt, the Buyer undertakes to ensure that the provided information and personal data are not misleading or incorrect.

3.3. The buyer undertakes to inform the Service Provider if he is allergic to specific products.

3.4. After registering, the Buyer undertakes not to transfer his login data to third parties. If the Buyer's login data becomes known to third parties, the Buyer must immediately inform the Service Provider about this within one working day.

3.5. If the data provided in the Buyer's order form changes, he must update it immediately.

3.6. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.

RIGHTS AND OBLIGATIONS OF THE SERVICE PROVIDER

4. Rights of the service provider

4.1. The service provider has the right to change or suspend the functions of the website www.21diena.lt, the layout of the elements on the website, to stop the operation of certain functions of the website.

4.2. The service provider has the right to change the scope or method of providing the services provided in the online store www.21diena.lt, to suspend or terminate the provision of services or part of them, to charge for services or part of services.

4.3. If the Buyer tries to harm the stability and security of the website www.21diena.lt or fails to fulfill its obligations, the Service Provider has the right to limit or suspend the Buyer's ability to use the website www.21diena.lt immediately and without prior warning.

4.4. The service provider has the right to cancel the order without prior notice to the Buyer, if the Buyer does not pay for the goods after choosing the provided payment method.

5. Obligations of the service provider

5.1. The service provider undertakes to enable the Buyer to use e-mail under the conditions set out in these Rules and the online store. services provided by the store.

5.2. The Service Provider undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer and on the specified date.

5.3. The service provider, being unable to deliver the goods ordered to the Buyer due to important circumstances, undertakes to return the money paid to the Buyer, if prepayment was made.

5.4. The Service Provider undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in the Rules.

DELIVERY OF GOODS

6.1. When ordering goods, the Buyer can choose the method of delivery of the goods.

6.2. The terms and prices of goods delivery are presented in the Buyer's basket. "Order" button; clicking means that the buyer has familiarized himself with the delivery conditions and prices and agrees with them.

6.3. Delivery of goods to the Buyer:

6.3.1. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.

6.3.2. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Service Provider regarding the delivery of the goods to the wrong entity.

6.3.3. The buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Service Provider's control. In this case, the Service Provider undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods.

6.3.4. In all cases, the Service Provider is released from responsibility for the violation of the deadlines for the delivery of goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of third parties or due to circumstances beyond the control of the Buyer.

6.3.5. The goods are delivered by the Service Provider or his authorized representative

6.5. The Buyer has no right to make any claims against the Service Provider, and the Service Provider is not liable to the Buyer:

6.5.1. if the Buyer incorrectly specified the delivery address of the ordered food;

6.5.2. if the Buyer incorrectly specified his phone number;

6.5.3. if the Buyer incorrectly indicated the desired delivery time of the ordered food;

6.5.4. if the Buyer did not accept the ordered food through no fault of the Service Provider (did not open the door, did not answer the phone call, etc.);

6.5.5. if the Buyer does not pay the Service Provider for the ordered food or refuses to pay for the ordered food in the absence of objective reasons;

6.5.6. due to technical failures, malfunctions and other disturbances of the website www.21diena.lt;

6.5.7. due to failures, disruptions and other types of disturbances in electronic banking;

6.5.8. The Service Provider has the right not to deliver the ordered food to the Buyer, if there is any one of the conditions specified in clauses 8.5.1-8.5.7 of the Rules.

6.6. If the Buyer does not pick up the goods within the specified period or if they cannot be delivered to the Buyer and the Buyer has paid for the goods, the representatives contact the Buyer regarding another time and/or method of delivery of the goods. If the Buyer still does not pick up the goods or fails to deliver them, such goods are returned to the Service Provider, the order is cancelled. Money paid back to the buyer is not returned.

PRODUCT QUALITY GUARANTEE AND EXPIRY DATE, RETURN AND EXCHANGE

7.1. The service provider provides a quality guarantee for different types of goods for a certain period of time, the specific term and other conditions of which are specified in the descriptions of such goods.

7.2. The service provider is not responsible for the fact that the size, shape, color or other parameters of the goods in the online store may not correspond to the real size, shape, color or other parameters of the goods due to the technical characteristics of the electronic device used by the Buyer.

7.3. The food ordered and delivered to the Buyer may differ externally from the e-mail due to the specifics of the food packaging and containers. photos of the dishes listed in the menu on the website.

RETURNS AND EXCHANGES

8.1. The buyer understands and agrees that the money for purchased gift vouchers is non-refundable.

8.2. The buyer understands and agrees that when ordering an individual nutrition plan, its price will be calculated individually with the addition of an additional fee. Creating and implementing an individual plan requires additional resources and work, so its price is higher than the prices of standard plans.

8.3. If the buyer demands a refund of the paid amount, it is returned within 5 days. from the receipt of the requisites required for the execution of the order. Money for used days is not refunded. If the meal was ordered with a discount, the refund amount will be calculated according to the standard 1d.d. prices (without discounts).

8.4. 21diena.lt has the right to independently adjust the delivery days taking into account the circumstances.

RESPONSIBILITY

9.1. The buyer is fully responsible for the correctness of the personal data provided by him. If the Buyer provides incorrect or inaccurate personal data, the Service Provider is not responsible for the resulting consequences and acquires the right to demand compensation for the direct losses suffered by the Buyer.

9.2. The buyer is responsible for the actions performed using e-mail. in the store.

9.3. After registering, the Buyer is responsible for storing and/or transferring his login data to third parties. If the services provided by www.21diena.lt are used by a third person who has connected to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.

9.4. The Service Provider is released from any responsibility in cases where losses arise because the Buyer, disregarding the Service Provider's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.

9.5. If the Service Provider 21diena.lt contains links to websites of other third parties, the Seller does not guarantee that the information that can be viewed by clicking on these links is correct, complete or accurate. Third parties are responsible for the content, correctness, completeness and accuracy of information provided by third parties. The seller is not obliged to check the transmitted or stored external information or to detect illegal actions.

RULES FOR USE OF DISCOUNT CODES

10.1. A discount code is a special combination of letters and/or numbers that allows you to purchase goods/services available in the online store at www.21diena.lt at a lower price.

10.2. The discount code is sent to the buyer's email. e-mail address indicated on the www.21diena.lt website or through other marketing channels when 21diena is conducting an advertising campaign in accordance with the terms of the relevant campaign.

10.3. 21day determines the validity period of the discount code each time. Discount codes may have a limited validity period, which may be indicated with the discount code being sent/displayed.

10.4. 21diena reserves the right to change the validity period of the discount depending on the results of the relevant campaign, shortening or extending the validity period of the discount.

10.5. The discount code may be subject to a minimum order amount requirement. In this case, the discount code will only apply to orders of a fixed value or more. This value can be different each time and is indicated in or next to the discount code.

10.6. The value of each discount code is determined by 21day. The value of the Discount Code is displayed in or next to the relevant Discount Code.

10.7. The discount code provides a discount of a certain amount in percent or in euros. The buyer has the right to use the discount code. The use of the discount code is not mandatory.

10.8. The discount code can be applied to some of the services/goods in the online store. The discount code is not valid when creating an Individual order or when purchasing a Gift Coupon.

10.9. 21diena, in accordance with the conditions of the relevant campaign, reserves the right to apply the discount code only when purchasing services/goods in the online store at www.21diena.lt. In this case, the discount code will not be applied when placing/extending the order by e-mail. by mail, phone, social networks or other means of communication.

10.10. Discount codes do not add up. Only one discount code can be used per purchase.

10.11. Only one discount code or gift voucher code can be used during one purchase.

10.12. If the full amount specified in the discount code/gift voucher code is not used, the difference is non-refundable.

10.13. Discount codes cannot be exchanged for cash

FINAL PROVISIONS

11.1. The Service Provider has the right to change and supplement these Rules. Each time, before using the food ordering service, the buyer must familiarize himself with the Rules and confirm that he agrees to comply with them. If the Buyer has started to fill out the order form, it is considered that the buyer has agreed to all the rules of the Food Order. The Seller shall not be liable if the Buyer placed an order without having familiarized himself with these Rules or any part thereof.

11.2 Only Buyers, as defined in Clause 1.3 of the Rules, have the right to buy in the online store www.21diena.lt. By approving the Rules, the buyer confirms that he has the right to buy goods in the online store www.21diena.lt.

11.3. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.

11.4. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If it is not possible to reach an agreement within 30 (twenty) calendar days, disputes are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.​

PROTECTION OF PERSONAL DATA

1. Any information that is related to personal data and that is registered on 21diena.lt is considered confidential and not made public.

2. The buyer can order goods on the 21diena.lt website. When ordering goods, the buyer must specify his personal data necessary for the proper fulfillment of the goods order in the relevant information fields provided by the Service Provider: name, surname, delivery address, telephone number and e-mail address.

3. By approving these Rules, the buyer agrees that 2.2. his personal data specified in point 21 would be processed for the purposes of selling goods and services on 21diena.lt, analyzing the Service Provider's activities and direct marketing.

4. The buyer, agreeing to the processing of his personal data for the purpose of selling goods and services in the Service Provider's online store, also agrees to the sending of informational messages to the e-mail address and telephone number indicated by him, which are necessary to fulfill the order for goods.

5. The buyer, who does not want his e-mail address to be processed for the purpose of direct marketing, must inform about this by e-mail. by mail 21diena@gmail.com.

6. The Service Provider undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Service Provider's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data can be disclosed to third parties only in accordance with the procedure provided by the legislation of the Republic of Lithuania.

7. The Buyer's identity document provided to the service provider's employee and the Buyer's data contained in it are used only for proper identification of the individual.

PRICES OF GOODS, PAYMENT PROCEDURES AND TERMS

1. The prices of goods on 21diena.lt and in the formed order are indicated in euros.

2. The Buyer can pay for the ordered goods in one of the following ways:

2.1. using the electronic banking services of Swedbank, Seb, Luminor, Citadele and Šiaulių bankas. Payments are processed using the MakeCommerce.lt payment platform;

2.2. payment order;

2.3. paying with VISA/MASTERCARD cards 21diena.lt. Payments are processed on the wix.com platform.

3. The Buyer, by approving the Rules, agrees that the documents for the purchase of goods - invoices - will not be provided to him (except after the order has been paid to a legal entity), but if necessary, they will be provided electronically to the e-mail address specified in the Buyer's registration form.

4. The Buyer and the Service Provider agree that after the Buyer submits the product order and the Service Provider confirms it, the price of the product may change, taking into account objective indicators that affect the price of the product, such as a technical error in information systems and additional costs related to the sale of the product to the Buyer. In this case, if the buyer does not agree to purchase the product at a new price, the buyer has the right to terminate the contract with the seller by informing about this by e-mail - 21diena@gmail.com . The parties agree that the costs related to the termination of the sales contract will not be reimbursed to the buyer.
